Terms of Service (General Rental Conditions)
Prices
The aim of our price calculation is that you feel comfortable in every respect and that you lack nothing, just like at your main residence. Therefore, the apartment was equipped with high quality furniture and inventory.
Your booking price will be shown on the invoice. You can find the currently valid prices for your specific travel date in our booking tool on our website (https://www.andalusia-sunshine.com). The valid list prices are stated on the website. There is a possibility that the prices in the booking portal may vary upwards and downwards due to seasonal fluctuations.
All prices are in euros.
The daily rate applies to the rental of the entire apartment and is independent of the number of occupied beds.
All costs are included in the inclusive price and already include the costs for distribution, final cleaning and a flat rate for energy costs. Please understand that extremely unusual energy consumption will be billed separately based on actual costs.
For longer stays (from 3 weeks) or as our regular guest and friend ask us for a discount (guestrelation@andalusia-sunshine.com). Discounts on the list price are shown openly on the invoice. The basis of the contract is the reduced price in the invoice.
Conclusion of Contract
With the booking request, you accept the validity of the following conditions (e.g. for payment and cancellation) as binding. The rental contract is concluded when you receive a written booking confirmation from us by email. Discounts and special conditions are shown on the invoice. The invoice and the general rental conditions constitute the rental contract. The consent to the contract is given by the implied action of paying the rent.
With the conclusion of the rental agreement, you acknowledge the Good Behavior Rules of the Apartment and SAMARA Resort including the pool rules Good Behavior Rules (attached as PDF) and undertake to comply with them.
After the booking confirmation, a copy of the identity cards or passports for all arriving persons must be sent by email (guestrelation@andalusia-sunshine.com) for easy check-in.
Booking Confirmation
The invoice contains the travel date and is considered as a binding booking confirmation.
Additional Fee
An amount of EUR 150.00 is charged for additional cleaning and change of bed linen and towels. The amount will only be billed if you specifically request it.
An amount of EUR 200.00 if the dishes were not washed on departure, the rubbish was not disposed of, the kitchen appliances or furniture were heavily soiled and/or the apartment was not handed over in a normal condition.
Minimum Rental Period
The minimum rental period is usual 6 days. The day of arrival and departure is usually on Friday, as far as the occupancy allows it also on other days.
Rental Item and Occupancy
The rented item is the luxury apartment shown on the invoice and described on the website https://www.andalusia-sunshine.com. You are not entitled to accommodate other people or more than the registered people in the apartment. The accommodation of a small animal is permitted. The rental price also includes the use of all public facilities, pools, whirlpool, saunas, kids area and gym.
The apartment has a maximum bed capacity of 6 persons (plus free of charge 1 infant under 3 years old).
Contractual Partners, Rental Period and Price
The agreed rental price and period will be shown on the invoice. The addresses of the host and the guest are also shown on the invoice as contractual partners.
Deposit / Violation of Duty
We trust you as our honest guest and that you treat our apartment like your home. Therefore we do not charge a deposit. If something is accidentally damaged, let us know by email during your stay and we will find a solution together to regulate the damage to both of our satisfaction, ideally via your private liability insurance. If your insurance company is not able to process it, we will offset the damage against your deposit. We will invoice you for a shortfall and pay you if you have a surplus. As a rule, our guests do not cause any damage and you will receive the deposit refunded from us within 7 working days. If a damage is not reported during the stay, we will still charge for the damage after your stay.
If there is a serious violation of the duty of care or if the furnishings of the apartment or the resort are willfully damaged, we are entitled to terminate the rental contract immediately and prematurely. In this case, the apartment must be vacated immediately. A proportionate repayment of the rental price does not take place in this case. In the event of willful damage to property or theft of furniture, bathrobes or towels, we will immediately file a criminal complaint with the authorities and sue for the damage incurred in court. We check the apartment for damages and completeness of things after your visit.
Defects
Our concern is that you have a great time in your holiday and that everything is to your satisfaction. In the unlikely event that the apartment should have a significant defect, inform us immediately and we will remedy the defect, which can be a defective large electrical appliance, for example. For such an inconvenience, we will reimburse you for one day's holiday.
Please understand that this must be a major defect and not something small, for example that something is missing in the equipment that you expected. We have furnished the apartment with great attention to detail with everything a home needs. If you miss something, let us know immediately and we will check whether we can still fulfil your wish at short notice during your stay.
In the unlikely event that the apartment is not habitable due to force majeure or something else, we will organize a comparable replacement apartment in the area for you free of charge.
Check-In / Check-Out Schedule
For new guests the arrival time at the apartment is after 4.00 pm. At the end of your stay, departure time is not later than 10.30 am. The times are necessary so that the cleaning company has enough time to refresh the apartment for the following guests. Please respect the time schedule.
When you entering the resort there is a gate where the security guard (24/7) will welcome you for the check-in and check-out procedure. The guard will expect your arrival. Here, an identity check is carried out and 2 apartment keys as well as the access code for the underground car park are handed over. Your will find the 2 magnetic cards for the SPA area on the dresser in the hallway of the apartment. If no copy of the identity card or passport has been sent to us by email, security will make a copy before the keys are handed over. You will find the WiFi Code in the apartment placed on a sign at the entrance door.
Payment
The total price is due upon booking and confirmation of the stay. You will also receive the invoice with the booking confirmation per email. Total Payment is made directly via the PayPal payment system or by transfer to our bank account due in one week.
Cancellation
Cancellations must always be made in writing (guestrelation@andalusia-sunshine.com). The following refunds will be paid for cancellations:

If we do not receive payment for the accommodation after 1 week, we reserve the right to cancel the reservation and give the accommodation to another guest. We will inform you about this.
COVID-19 regulation
If you are unable to make your arrival due to travel restrictions or an illness related to the COVID-19 pandemic, we offer you the option of rebooking your booking to another period free of charge. Please contact us as soon as possible and send us official proof for verification and the desired rebooking period by email (guestrelation@andalusia-sunshine.com). If the daily price differs, you will be billed an additional price. You will be reimbursed for a reduced price. We charge a cancellation fee of 50% of the original total amount if a rebooked trip is not taken.
Terms of use for guest WiFi
The condition explains your rights and obligations in connection with the use of the guest WLAN in the apartment that we make available to you free of charge. We are not a telecommunications service provider. The provision takes place according to the technical possibilities of our telecommunications service provider. We assume no liability for the functionality, disruptions, local coverage and transmission speeds of our guest WiFi. Access may be disrupted during technical repair and maintenance work. We accept no liability for the non-functioning of certain services. Basically, surfing the Internet and retrieving emails works. Since the provision is free of charge, there is no entitlement to use or compensation for damages due to non-provision. As a rule, you will be able to use it without any problems.
With the use of the guest WLAN, all actions that violate applicable law, violate the rights of third parties or violate the principles of the protection of minors are prohibited.

As a user, you are responsible for all actions that you take in connection with the use of the guest WLAN. We assume no responsibility for your actions and will be released from liability by you.
In particular, we are released from all claims asserted against us by third parties due to a violation by you of legal regulations, third-party rights (in particular personal, copyright and trademark rights) or contractual obligations, assurances or guarantees.
In addition, you undertake that you will bear any costs incurred by us for legal fees and court costs. You also undertake to cooperate immediately and fully in the clarification of the facts and to make the necessary information available to us in a suitable manner.
We expressly point out that the use of a guest WLAN service entails particular risks for data security. The data traffic between your end device and the WLAN base station may be unencrypted and may be viewed by third parties. There is therefore a fundamental risk that malware can get onto your end device when using the WLAN. It is your responsibility to ensure that your data is protected by appropriate encryption software and firewalls. We expressly assume no liability for the fact that your data security is not guaranteed and a third party can access your data. In particular, we are not liable for damage resulting from the use of an unsecured WLAN connection.

Data Protection
With this data protection declaration, we would like to inform you about the type, scope and purpose of the processing of personal data. Personal data is all data that is personally related to you, e.g. name, address, email address or your user behavior. The data protection declaration applies to all data processing operations carried out by us in connection with the booking and payment of your trip.
For this purpose we store your data. We store the data for a period of 5 years in order to grant you a homecoming discount when you return. When booking and concluding the rental agreement, you expressly agree to the data processing and data storage. It is expressly pointed out that you can revoke your consent at any time with effect for the future.

Your personal data must be stored in a safe and confidential manner. We keep your personal information on computers with limited access placed in controlled facilities. However, we cannot guarantee 100% safety when it comes to data transfers on the internet. There is always a risk that unauthorized individuals get access to information when it is transferred and stored electronically. Therefore, when you submit your personal information you are responsible.
Limitation of Liability
We are only liable insofar as we have breached a material contractual obligation. In abstract terms, essential contractual obligations are those obligations whose fulfillment is essential for the proper execution of the rental agreement and on whose observance the guest can regularly rely. In these cases, liability is limited to the rental fee paid. Liability under the Product Liability Act remains unaffected. This also applies to our vicarious agents. When using electronic devices, make sure that the device is working properly. We assume no liability for the improper use of electronic devices in the apartment and resort.
Parental Responsibilities
Parents are responsible for their children and undertake to look after their children in the pool areas. There are no lifeguards or lifeguards at the resort. Non-swimmers must wear swimming aids in the pool. Please keep children away from balcony railings and electrical outlets as there may be a risk of falling or electric shock. In the apartment there are cleaning materials in the utility room and in the kitchen cabinets that are dangerous for children. For young children, keep the remedies out of the reach of your children. We accept no liability for breaches of parental care obligations. This also applies to pets.
Final Provisions
The law of the Federal Republic of Germany is valid. If individual provisions of the rental agreement and the general rental conditions are or become invalid, they will be replaced by the current legal situation and the invalidity of individual conditions will not affect the effectiveness of the remaining conditions.
